TERMS AND CONDITIONS

The following terms and conditions apply to all purchases of Shot in the Dark off-the-shelf video tapes, CDs, DVDs and related training materials made on or after 19 August 2004. The use of this site for placement of order indicates your acceptance of these terms and conditions. Please print out a copy for your records or contact Shot in the Dark.

Permitted Use / Restrictions
Shot in the Dark will supply products to customers for them to use for education and training purposes for their officers, employees and contractors. Where the customer is a consultant, the programmes may be used for education and training purposes for the consultant's clients, on condition that the products remain in the possession and under the control of the consultant at all times.

The products may only be used in their complete form, as supplied, without any editing or alteration to the audio or visual content, UNLESS STATED ON THE PRODUCT or agreed in advance with Shot in the Dark.

Permitted use of the products at the advertised prices is for use on a single video or computer screen at any one time. The customer shall not disseminate a product by satellite, terrestrial or cable broadcast or by network or electronic transmission without advance written agreement of terms and payment with Shot in the Dark. Where a customer wishes to use a product on an internal intranet, a licence agreement may be prepared for an agreed fee, based on the size of organisation and number of users.

Copying is illegal
Customers are not allowed to copy or duplicate any Shot in the Dark material without advance written agreement with Shot in the Dark or UNLESS STATED ON OR WITHIN THE PRODUCT.

The products are the copyright of Shot in the Dark and are protected by law. The customer is not allowed to:
1. Copy or duplicate a product in whole or in part (except where a CD-ROM format requires the product to be installed on the customer's equipment)
2. Edit or amend or add to a product or incorporate it within other material unless agreed in advance in writing with Shot in the Dark
3. Sell, rent, lend or sub-license a product unless agreed in advance with Shot in the Dark.

Price
The customer will pay Shot in the Dark the price advertised at the time of placing the order. Prices are displayed on our website www.shotinthedark.co.uk or in printed direct mail promotions. Current prices can be confirmed by telephoning Shot in the Dark on 01484 65 11 11. An invoice will be supplied for all products ordered, clearly showing the due price of each item. VAT is due on all UK orders unless the product is exempt or zero-rated. Delivery charges within the UK (at Royal Mail 2nd class or parcel rate) are included in the price. If a special service or express delivery is required, the additional costs may be charged to the customer.

Payment Terms
Shot in the Dark reserves the right to refuse credit. Where credit is given, payment is due strictly 30 days from the date of invoice. Shot in the Dark has the right to charge interest at the rate of 1.5 per cent per month for any day beyond 30 days for which payment has not been received. All products remain the property of Shot in the Dark until payment in full has been received.

Delivery
It is our committed intention to supply products from our catalogue within 7 working days of receipt of order. The customer will be notified immediately if any delays are anticipated. Whenever possible, orders are despatched within 24 hours of receipt of order. If the goods have not been received within 7 working days of the expected receipt of order date, it is recommended that customers contact Shot in the Dark by phone, fax or e-mail (T: 01484 65 11 11- F: 01484 643 930- info@shotinthedark.co.uk) to confirm
a) that the order was received
b) when the order was despatched
c) by which service the order was despatched and expected due delivery date.

Depending on the size of the order, most products are despatched by Royal Mail 2nd class or parcel post or by Business Post 3-day service.

Every effort will be made to fulfil orders required for a specific deadline. Where necessary, delivery arrangements will be discussed with the customer to ensure that these will meet their requirements.

Cancellation, Returns and Refunds
Shot in the Dark guarantee to replace any video cassette, CD or DVD which is found to be faulty or becomes damaged during its lifetime.

Cancellation - It should be noted that once an order is received, Shot in the Dark accept this as an agreement to supply products. Once Shot in the Dark has accepted an order, the customer has no right to reject the goods. However any faulty or damaged videos, CDs or DVDs will be replaced (see Returns below). Shot in the Dark cannot accept responsibility for incorrect orders placed by a customer, although it may be possible to exchange products. Once the goods have been despatched to the customer, it becomes the customer's responsibility to ensure their safe return, in unmarked, re-saleable condition, within one working week, at the expense of the customer.

Returns - if a fault or damage is identified, the customer should notify Shot in the Dark by phone or e-mail as soon as possible. The customer will then be asked to confirm the problem in writing and return the faulty item to Shot in the Dark, at the expense of the customer.

Once the faulty item is received, Shot in the Dark will despatch a replacement product at no additional cost.

As technology is changing rapidly, it is the customer's responsibility to ensure that the items ordered are compatible with the equipment in which it is intended they will be used.

Refunds
Customers should contact Shot in the Dark if they believe that there are any circumstances, outside these Terms and Conditions, under which a refund is due.

Disclaimer
Whilst great care is taken to ensure the accuracy of the content of the Shot in the Dark products, the Producers disclaim any liability for loss, injury or damage arising from omissions, inaccuracies, application or interpretation of the products.
Environmental and Health and Safety Law is changing rapidly and we advise contacting the relevant authority (e.g. Environment Agency, SEPA, HSE etc) if you are unsure of your legal position.

Shot in the Dark cannot be responsible for damage to video cassette players or computers through incorrect handling or mis-use by customers or incompatibility between equipment and products supplied.
